Acceptable Use Policy

1. PURPOSE AND SCOPE

This Acceptable Use Policy ("AUP") governs your use of the REPLR platform, including the website at replr.ai, all associated applications, the REPLR Marketplace, the REPLR API, and any related services (collectively, the "Service") operated by REPLR, Inc., a Delaware corporation ("REPLR," "we," "us," or "our").

This AUP applies to all users of the Service, including individuals who create AI characters ("Creators"), users who interact with AI characters ("Users"), developers who access the REPLR API ("Developers"), and any other person or entity that accesses or uses the Service in any capacity. By accessing or using the Service, you agree to comply with this AUP. If you do not agree, you must immediately cease all use of the Service.

This AUP supplements and is incorporated into our Terms of Service. In the event of a conflict between this AUP and the Terms of Service, the Terms of Service shall control unless this AUP expressly states otherwise. Capitalized terms not defined herein have the meanings assigned in the Terms of Service.

2. PROHIBITED CONTENT

You may not create, upload, transmit, distribute, or otherwise make available through the Service any content that falls within the following categories. These prohibitions apply to all content on the platform, including but not limited to REPLR character configurations, character descriptions, conversation inputs, marketplace listings, profile information, and any content generated through the use of AI characters.

  • Violence and threats. Content that threatens, incites, glorifies, or promotes violence against any individual or group, including credible threats of physical harm, instructions for committing acts of violence, or graphic depictions of extreme violence intended to shock or disturb.
  • Child sexual abuse material (CSAM). Any content that sexually exploits or endangers minors, including but not limited to visual depictions, written descriptions, AI-generated imagery, or any other material that depicts, promotes, or facilitates the sexual exploitation of minors. REPLR maintains a zero-tolerance policy and will report all such material to the National Center for Missing & Exploited Children (NCMEC) and applicable law enforcement authorities.
  • Non-consensual intimate imagery. Intimate, sexual, or nude imagery of any person created, distributed, or shared without the depicted individual's explicit consent, including AI-generated deepfakes and manipulated media of real individuals.
  • Harassment and bullying. Content that targets specific individuals or groups with the intent to harass, intimidate, bully, or demean, including sustained unwanted contact, coordinated campaigns of abuse, doxxing, or malicious use of AI characters to target individuals.
  • Hate speech. Content that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic under applicable law.
  • Promotion of illegal activity. Content that promotes, facilitates, or provides instructions for engaging in illegal activities, including but not limited to drug trafficking, weapons manufacturing, human trafficking, fraud, money laundering, or any other criminal enterprise.
  • Self-harm and suicide. Content that promotes, glorifies, or provides instructions for self-harm or suicide. This includes content that depicts self-harm as a desirable outcome, provides methods or means of self-injury, or discourages individuals from seeking professional help. If you or someone you know is in crisis, please contact the 988 Suicide & Crisis Lifeline by calling or texting 988.
  • Terrorism and violent extremism. Content that supports, promotes, or recruits on behalf of terrorist organizations or violent extremist groups, including propaganda, recruitment materials, operational planning, or content that glorifies terrorist acts.
  • Unauthorized personal information. Sharing, distributing, or exposing the personal, private, or confidential information of any individual without their explicit consent, including but not limited to home addresses, phone numbers, financial information, government-issued identification numbers, medical records, or login credentials.

3. PROHIBITED CONDUCT

In addition to the content prohibitions above, the following activities are strictly prohibited when using the Service:

  • Reverse engineering. Decompiling, disassembling, reverse engineering, or otherwise attempting to derive the source code, underlying algorithms, model weights, training data, or architectural details of the Service or any AI models used within the Service, except to the extent expressly permitted by applicable law notwithstanding this restriction.
  • Unauthorized access. Accessing or attempting to access any portion of the Service, other users' accounts, or computer systems or networks connected to the Service through hacking, password mining, credential stuffing, or any other unauthorized means.
  • Scraping and data mining. Using automated tools, bots, scrapers, crawlers, or similar technologies to extract, harvest, collect, or mine data from the Service without our prior written consent, except as expressly permitted through the REPLR API pursuant to valid API credentials and within applicable rate limits.
  • Circumventing rate limits. Attempting to circumvent, bypass, or manipulate any rate limits, usage quotas, content filters, safety mechanisms, or other technical restrictions implemented in the Service or the REPLR API.
  • Credential sharing. Sharing, selling, transferring, or otherwise providing access to your account credentials, API keys, or authentication tokens to any third party, or using credentials belonging to another person or entity without proper authorization.
  • Interfering with the Service. Taking any action that imposes, or may impose, an unreasonable or disproportionately large load on our infrastructure, or that interferes with, disrupts, or creates an undue burden on the Service, its networks, or the experience of other users, including denial-of-service attacks, injection attacks, or exploitation of software vulnerabilities.
  • Spam. Sending or facilitating unsolicited bulk communications, chain messages, junk messages, or any other form of spam through the Service, including using AI characters to generate or distribute spam content.
  • Impersonating REPLR staff. Falsely representing yourself as an employee, agent, representative, or affiliate of REPLR, or creating AI characters that falsely claim to be official REPLR representatives or support agents.

4. AI-SPECIFIC RULES

The following rules apply specifically to the creation, configuration, and use of AI characters ("REPLRs") on the platform:

  • Impersonation of real people. You may not create REPLRs that impersonate real, identifiable individuals — whether public figures or private persons — without the verifiable consent of the person being depicted. Parody and satire characters must be clearly labeled as such in their name and description to avoid user confusion. REPLR reserves the right to remove any character that creates a likelihood of confusion regarding the identity or endorsement of a real person.
  • Fraudulent professional advice. You may not create or configure REPLRs that present AI-generated output as genuine professional advice in regulated fields, including but not limited to medical diagnosis or treatment, legal counsel, financial or investment advice, psychological or psychiatric therapy, or any other domain where reliance on unqualified advice could cause material harm. Characters that discuss these topics must include clear disclaimers that their outputs are AI-generated and should not substitute for consultation with a licensed professional.
  • Disinformation. You may not use AI characters to knowingly generate, amplify, or distribute false or misleading information with the intent to deceive, manipulate public opinion, interfere with elections or democratic processes, or cause harm. This includes the creation of synthetic media (deepfakes) designed to mislead viewers about the authenticity of the content.
  • Training competing models. You may not use outputs generated by REPLR or REPLR characters to train, fine-tune, distill, or otherwise develop competing artificial intelligence or machine learning models without our prior written consent. This includes systematically collecting AI-generated responses for the purpose of building training datasets for third-party models.

5. MARKETPLACE RULES

The following rules apply to all Creators who publish AI characters on the REPLR Marketplace:

  • Plagiarized or stolen characters. You may not publish characters that copy, substantially replicate, or are derived from other Creators' characters without their permission. Each Marketplace listing must represent your own original work or work for which you hold sufficient rights. REPLR will process takedown requests from original creators whose work has been appropriated.
  • Misleading descriptions. Character listings must accurately describe the character's behavior, capabilities, personality, and any limitations. You may not use false, exaggerated, or deceptive claims to induce users to subscribe to or purchase access to your character. All screenshots, previews, and sample interactions must be representative of the actual user experience.
  • Artificial rating manipulation. You may not engage in any activity designed to artificially inflate or manipulate ratings, reviews, download counts, or other metrics for your Marketplace listings. This includes purchasing reviews, creating fake accounts for self-review, coordinated rating campaigns, offering incentives for positive reviews, or leaving false negative reviews on competing listings.
  • Spam listings. You may not flood the Marketplace with duplicate, near-duplicate, low-quality, or auto-generated listings. Each published character must offer meaningfully distinct value to users. REPLR reserves the right to remove listings that it determines are spammy or that degrade the overall quality of the Marketplace.
  • Content guideline compliance. All Marketplace listings must comply with the content prohibitions set forth in Section 2 of this AUP, the Terms of Service, and the Creator Agreement. Characters that violate these guidelines will be removed, and Creators may be subject to enforcement actions as described in Section 7 below.

6. API USAGE RULES

The following rules apply to all Developers who access the REPLR API. These rules supplement and are subject to the API Terms of Service:

  • Rate limit compliance. You must comply with all rate limits, usage quotas, and throughput restrictions communicated through the API documentation, response headers, or direct notice from REPLR. Automated retries must implement exponential backoff. Sustained attempts to exceed rate limits may result in temporary or permanent revocation of API access.
  • No unauthorized resale. You may not resell, sublicense, redistribute, or provide pass-through access to the REPLR API or API outputs to third parties without our prior written permission. Building products that incorporate API outputs for your own end users is permitted under the API Terms of Service, but white-labeling or reselling the API itself requires a separate commercial agreement.
  • API key security. You are solely responsible for maintaining the confidentiality and security of your API keys. You must not embed API keys in client-side code, public repositories, or any other location where they may be exposed. You must immediately notify REPLR at security@replr.ai if you believe your API key has been compromised. You are responsible for all usage and charges associated with your API key, whether authorized or not.
  • Data handling obligations. You must handle all data obtained through the REPLR API in compliance with applicable data protection laws, including the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and any other relevant legislation. You may not use API data to build user profiles, track individuals across services, or any other purpose beyond the scope described in your API application unless explicitly authorized in writing.
  • No circumvention of billing. You may not attempt to circumvent, manipulate, or exploit any billing mechanism, free-tier limitation, or promotional offering associated with the REPLR API. This includes creating multiple accounts to obtain additional free-tier allocations, manipulating request parameters to reduce billable usage, or exploiting billing system errors.

7. ENFORCEMENT AND CONSEQUENCES

REPLR reserves the right, but is not obligated, to monitor use of the Service for compliance with this AUP. We may investigate any suspected violation of this AUP and take any action we deem appropriate, in our sole discretion, including but not limited to:

  • Warning. Issuing a formal warning notifying you of the violation and requiring immediate corrective action. Warnings are documented and will be considered in evaluating the severity of any subsequent violations.
  • Content removal. Removing, disabling access to, or modifying any content that violates this AUP, with or without prior notice to you. Where feasible, we will notify you of the specific content removed and the reason for removal.
  • Temporary suspension. Suspending your access to all or part of the Service for a defined period. During suspension, you will not be able to access your account, publish content, or use the API. Subscription billing may continue during a suspension unless otherwise specified.
  • Permanent termination. Permanently terminating your account and revoking all access to the Service. In the case of Creators, this includes removal of all Marketplace listings and forfeiture of any unpaid revenue share balances below the minimum payout threshold. Permanent termination is typically reserved for severe or repeated violations.
  • Law enforcement referral. We reserve the right to report any activity that we believe violates applicable law to the relevant law enforcement authorities, regulatory bodies, or other appropriate third parties. We will cooperate with law enforcement investigations and comply with valid legal process, including subpoenas, court orders, and search warrants.

The specific enforcement action taken will depend on the nature, severity, and frequency of the violation, as well as any prior history of violations. REPLR is not required to provide advance notice before taking enforcement action, particularly where the violation poses an immediate risk to user safety, the integrity of the platform, or legal liability.

8. REPORTING VIOLATIONS

We encourage all users to report suspected violations of this AUP. You can report violations through the following channels:

  • Email. Send a detailed report to safety@replr.ai. Please include as much relevant information as possible to facilitate our investigation.
  • In-app reporting. Use the report button available on user profiles, character pages, Marketplace listings, and within chat interfaces. In-app reports are routed directly to our Trust & Safety team for review.

When submitting a report, please include the following information where available:

  • A clear description of the violation and why you believe it contravenes this AUP.
  • The username or profile URL of the account involved.
  • Links to or screenshots of the content at issue.
  • The date and approximate time of the incident.
  • Any additional context that may assist our investigation.

All reports are treated confidentially. We will not disclose the identity of the reporter to the reported party, except where required by law or legal process. We do not tolerate retaliation against individuals who submit good-faith reports.

9. APPEALS

If an enforcement action has been taken against your account or content and you believe the action was made in error or that there are mitigating circumstances, you may submit an appeal by emailing appeals@replr.ai within thirty (30) calendar days of the enforcement action.

Your appeal should include:

  • Your username and the email address associated with your account.
  • A description of the enforcement action you are appealing (include any reference numbers provided in the enforcement notification).
  • A clear explanation of why you believe the action was incorrect, including any relevant evidence or context.

We will acknowledge receipt of your appeal within two (2) business days and aim to provide a substantive response within ten (10) business days. Appeals are reviewed by a member of our Trust & Safety team who was not involved in the original enforcement decision. The outcome of the appeal will be communicated to you in writing and will constitute our final decision on the matter.

10. CHANGES

REPLR reserves the right to modify this AUP at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, provide additional notice through the Service (such as an in-app notification or a banner on our website) or via email to the address associated with your account.

Your continued use of the Service following the posting of changes constitutes your acceptance of those changes. If you do not agree with the revised AUP, you must discontinue your use of the Service. We encourage you to review this page periodically to stay informed about our acceptable use requirements.
